Our Duty to Safeguard Your Health Information

TheraPeace PLLC is required by law to maintain the privacy of your Protected Health Information (PHI) and to provide you with this Notice of Privacy Practices. We are required to follow the privacy practices described in this notice while it is in effect. This notice takes effect on the date listed above and will remain in effect until we replace it.

We reserve the right to change our privacy practices and the terms of this notice at any time. We will post any revisions on our website and provide you with a copy of the revised notice upon request.

How We Use and Disclose Your Health Information

Treatment: We may use and disclose your PHI to provide, coordinate, or manage your mental health care and any related services. This includes sharing information with other health care providers who are treating you.

Payment: We may use and disclose your PHI so that we can bill and collect payment for services rendered to you. This may include disclosures to your health insurance plan.

Health Care Operations: We may use and disclose your PHI for our own operations, such as quality assessment activities, staff training, licensing, and conducting or arranging for other business activities.

Required by Law: We may disclose your PHI when required to do so by applicable federal or state law, including for mandatory reporting of abuse, neglect, or domestic violence, or to avert a serious and imminent threat to health or safety.

Your Rights Regarding Your Health Information

Right to Access: You have the right to inspect and copy your PHI. To request access, submit a written request to our Privacy Officer. We may charge a reasonable fee.

Right to Amend: You have the right to request that we amend your PHI if you believe it is incorrect or incomplete. We may deny the request under certain circumstances.

Right to Request Restrictions: You may request restrictions on how we use or disclose your PHI. We are not required to agree to your request, but we will inform you of our decision.

Right to an Accounting of Disclosures: You have the right to request a list of certain disclosures we have made of your PHI in the past six years.

Right to a Copy of This Notice: You have the right to request a paper copy of this notice at any time, even if you have agreed to receive it electronically.

Right to File a Complaint: If you believe your privacy rights have been violated, you may file a complaint with TheraPeace PLLC or with the Secretary of the U.S. Department of Health and Human Services (HHS). We will not retaliate against you for filing a complaint.

Breach Notification

In the event of a breach of unsecured PHI, TheraPeace PLLC will notify affected individuals without unreasonable delay and no later than 60 days following discovery of a breach, in accordance with the HIPAA Breach Notification Rule (45 CFR §§ 164.400–414).
